This Agreement lays out the rules for using our platform, and we may modify it at any time by notifying you on a thirty-day (30) calendar. Using Bidmysafari.com, you agree to abide by all the terms and conditions, privacy policy, and other contractual agreements linked to our website. If you do not agree with these terms and conditions, policies, and other contractual agreements, please do not use our website. It's important to note that other services offered on our platform may have additional terms and conditions and guidelines posted on relevant pages. We strongly recommend reading and understanding these before using the respective service. We value your trust and are committed to providing a safe, fair, and helpful experience on our website. If you have any questions or concerns about our services or this Agreement, please don't hesitate to contact us.

1. DEFINITION 

In this User Agreement, the following words and expressions have specific meanings:-

"Safari" means a Travel Plan or Trip, or wildlife safari, or a travel, hotel reservation, car rental, and any travel idea that a user has about places to go or tour destinations, things to do or preferred travel or tours service, preferred travel suppliers, budget, travel time, and any other travel or tours arrangement.

"Trip" means a trip, safari, wildlife safari, or travel plan, hotel reservation, car rental, and any travel idea that the user has about places to go or tour destinations, things to do or preferred travel or tours service, preferred travel suppliers, budget, travel time, and any other travel or tours arrangement.

"Travel Offers" means any online packages, package holidays, travel itineraries, hotel offers, flight offers, car rental offers, and any travel arrangement offers listed by registered Travel Suppliers on Bidmysafari.com.    

"Traveler" means user registered to Bidmysafari.com with the intention to plan and book safari, travel plan, hotel reservation, or car rental, or any travel arrangement.

"Travel Supplier or Operator" means legally registered entity as sole propitiator or company registered to Bidmysafari.com to provide safari and other travel arrangement services. Travel Supplier may include Tour Operator, guides, Travel Agent, Airline, Cruise lines, Car rentals, Travel Insurance, railway, Hotel/Lodge/Airbnb/Homestay, and any legally registered entity of safari and travel services.

"Plan a Trip " means write description about a trip, or safari, or hotel reservation, car rental, or any travel idea, places to go or tour destinations, things to do or preferred travel or tours service, preferred travel suppliers, budget, travel time, and any other travel or tours arrangement and submit.

“Ratings & Reviews” means written reviews and rating about the performance of Traveler or Travel Supplier as per Travel & Tour Industry Standards, Traveler Contract and User Agreement. 

“Bid” means submitting best offer or proposal itinerary according to the Travel Plan, trip, safari submitted by Traveler.

“Best Bid” means best offer or proposal itinerary submitted by Travel Supplier and then selected and awarded according to Traveler’s preference. 

"The Company or companies" means Bid My Safari LLC and partners. 

"We,” “our,” and “us,” means Bid My Safari LLC, the company, companies, partners, our successors, affiliates, assignees and service providers.

"You" or "your" means User, Traveler, or Travel Supplier registered on Bidmysafari.com, or browsing and using the Website.

“Customer” shall include the masculine and the feminine gender as well as juristic persons.

"User", "you" or "your" means an individual who visits or uses the website.

"Website" means the websites operated by Bid My Safari LLC. It is available at www.bidmysafari.com and any related tools or applications.

"Membership" means the membership plan you open when you register on Bidmysafari.com.  

2. USER ACCOUNT

To use bidmysafari.com, users must register an account on the website. By doing so, users agree to abide by the User Agreement, which outlines the guidelines for appropriate behavior on the platform. This includes conducting oneself with integrity and respect toward others when using the account, as it is intended to facilitate safari and other travel services. In addition to agreeing to behave appropriately, users should be aware that they are responsible for keeping their account information secure. This is of utmost importance as it ensures that their personal information and travel plans remain confidential and secure, providing a sense of safety and protection.

3. VERIFICATION

To ensure the safety and security of all users on bidmysafari.com, we require that all users go through the necessary verification. Your cooperation in providing accurate information and documents is appreciated and will help facilitate this process. Please be aware that if we cannot obtain the information required for verification, we may need to suspend or close your account for everyone's protection. If your details require updating, we will do so to match the identity documentation you submitted. Additionally, please note that disbursements such as wire transfers will only be sent to the beneficiary matching the information you provided for security purposes. 

4.TRIPS

When using bidmysafari.com to plan, book, and pay after service or by milestones, it's essential to keep in mind the following terms::-  

1. Provide complete information about your travel plan, including the destination, dates, duration, service category, type of accommodation, and tentative budget;   
2. We empower you to engage in direct negotiations with suppliers and select the most suitable bidder for your requirements. Once you've identified the perfect match, finalize the agreement and establish a payment plan that is mutually beneficial;
3. Provide the company and travel supplier with the necessary travel documents to process the booking;
4. Depending on your preferences and the supplier's policies, you may make payments by milestone or after-service 

5. TRAVEL OFFERS

To purchase a Travel Offer on Bidmysafari.com, you must acknowledge and comprehend the following terms:-

1. You must read and fully comprehend the Travel Offer itinerary before booking and authorizing the release of funds from your wallet; 
2. You will receive service according to the offer itinerary;
3. You will refrain from demanding exclusive services during your travels. 

6. USER CONTRACT

When you select a Travel Supplier as the winner for your Travel plan or buy an Offer, you must acknowledge that you are entering into a User Contract with them. In the event of any breach of the Traveler Contract, you will be held accountable to the Travel Supplier. It is essential to ensure that you do not enter into any contractual arrangement that conflicts with the User Agreement. In case of any dispute, you must enforce your rights while maintaining a cordial relationship with the Travel Supplier

7. CANCELATION 

We kindly remind you that canceling your booking within the permitted time frame per the User Contract and User Agreement would ensure you don't incur additional charges. However, if you cancel your reservation beyond the allowed period, we would like to inform you that the User Contract and the User Agreement may require fees to be charged. To cancel your booking without any cost, please ensure that you do so within the permitted period as per the User Contract and User Agreement. If you cancel outside of this timeframe, charges will apply as per the User Contract and User Agreement.  

8. COMMUNICATION 

All communication with other users on bidmysafari.com must be through the website's text chat functionality and direct messages. Conducting communications or transactions outside of the website may result in a penalty. The company may use your user information to provide messaging services and read all correspondence posted on the website to investigate fraud and ensure compliance.

9. PAYMENT PLANS

At our company, we recognize that our users have diverse payment preferences. To ensure your convenience, we offer a range of flexible payment options, such as payment by milestones, after-service, or cash before-service, allowing you to manage your payments in a way that suits you best. With our basic or premium membership plans, you can pay by milestones. You can secure your safari, hotel, car rental, and other travel arrangements and make payments in manageable installments. For instance, when booking a safari, you can pay a deposit upfront and spread the remaining balance over installments. This option empowers you to choose a payment plan that aligns with your budget and income, providing financial flexibility. On the other hand, if you subscribe to our premium plan, you can pay after the service is complete or by milestones. You pay the total amount after the work has been delivered to your satisfaction. For instance, if you're booking a guided tour, you can load an equivalent amount into your wallet and release the total amount after completing the tour, and you're satisfied with the service. These options provide the flexibility and security that our users need when making payments. Using our flexible payment plans, you acknowledge and agree that you are responsible for making payments on time and in full. If you fail to pay on time, we may charge late fees or interest, and your booking may be canceled. You also agree to pay any applicable fees or charges associated with your chosen payment plan. Our company reserves the right to modify or terminate any payment plan at any time at our discretion. However, we will notify our users before any changes to their payment plan.

10. RELEASE OF FUNDS

As our valued customer, you agree that you are solely responsible for initiating the required funds and authorizing us to release them to facilitate payment for travel services. We want to remind you that we can release funds from your wallet to the Travel Supplier only after you initiate and give us a release order. Kindly be aware that we will initiate the release of funds from your wallet once we have received your release order. This will be followed by a verification process, which may include confirming your identity or requesting additional information as per our User Agreement. We take the security of your funds and personal information seriously. We have implemented stringent measures to ensure a smooth and secure payment process. You can always contact our customer service team with any questions or concerns.  

11. WITHDRAWAL

If you decide to withdraw funds from your wallet, it is essential to understand the process and the terms and conditions that apply. Firstly, it is your responsibility to initiate the withdrawal process. We will release the funds from your wallet only after we receive your release order and conduct the necessary verification to process payment to your bank account or wallet. As a part of our User Agreement, we may seek to verify your identity or request additional information before releasing the funds. This ensures your account's security and safety and prevents fraudulent activities. It's important to be aware that we have set a minimum and maximum withdrawal amount from your wallet. This means you cannot withdraw an amount lower than the minimum or higher than the maximum, which can help you plan your withdrawals effectively. Furthermore, we may impose a delay in withdrawing your funds from your wallet to allow us enough time to conduct verification. This delay is necessary to ensure the transaction's authenticity and prevent unauthorized withdrawal requests. To initiate the withdrawal process, you must provide us with all the required documents for verification. It's important to note that we charge a commission for every transaction conducted on our platform, which is deducted automatically from the released amount. We believe in transparency, and we want you to know that the commission charged by Bid My Safari is used to help us maintain and improve the platform and provide quality services to buyers and sellers. It's also important to acknowledge and agree that the Travel Supplier will receive the amount released minus the commission charged by Bid My Safari. If you have any questions or concerns about our commission policy, please feel free to contact our customer support team. We're always happy to help.

13. PREMIUM SERVICE

When you plan and post your trip on Bidmysafari.com, you can use premium services such as Urgent, Private, Sealed, and Featured to optimize your experience. The Urgent service ensures that your post appears at the top of the search results, making it more visible to potential safari providers. The Private service allows you to hide your identity from providers until you select a bid. The Sealed service hides the details of your trip until you choose a provider, ensuring that you get the best possible price and service. The Featured service highlights your post on the website, attracting more attention from providers. It's important to note that using these premium services may incur charges. You acknowledge and agree to accept the applicable charges when using these services.  

14. FUNDS 

Our website offers a convenient way to enable payment for travel needs by allowing you to load funds into your wallet. These funds are managed in our accounts held with financial institutions. However, it's important to note that the funds in your wallet are not held separately by us and may be commingled with our funds and other members' funds to facilitate payment of plans and travel offers. To ensure that you understand the terms and conditions, we'd like to clarify a few points. Firstly, it's important to note that Bid My Safari is not a bank or other licensed financial institution and does not provide banking or any financial services. The funds shown in your wallet that you owe us represent our unsecured obligations to you concerning your rights to direct us to release or make payment for a safari or other travel service as guided by the User Agreement. Additionally, it's essential to understand that the virtual funds in your wallet are solely to facilitate payment for a safari or travel service confirmed on our website.

15. REFUND

If you ever encounter any issues with the services provided, it's always best to try and resolve them in good faith. If negotiations fail, you can file a dispute or claim related to refund@bidmysafari.com. The company or any third party involved will try to settle the dispute through binding arbitration, per the User Agreement. If you're eligible for a refund, we'll direct the Travel Supplier to process it within the permissible period. To make the refund process easier for you, please take note of the following  :-

1. Requesting a refund is straightforward. You can access our customer support website or email us at refund@bidmysafari.com. Our customer support team will guide you through the process; 
2. Any refunds that need to be processed will only be returned to the original deposit source and cannot be redirected to a different payment source. This is to ensure your refund is secure and prevent fraudulent activity; 
3. Under certain circumstances, the company may refund funds to your wallet, even if you have yet to request it. This could be because of legal requirements or if we believe a refund may prevent disputes or transaction costs. If we refund funds to your wallet, we'll inform you;
4. All charges associated with refund processing, including chargebacks, credit card fees, merchant fees, banking transaction fees, and all costs incurred by the company in handling refunds, will be your responsibility to pay. We'll inform you of the charges before processing the refund. 

16. TRANSACTION FEES

19. PROMOTION AND MARKETING

30. ACCOUNT TERMINATION

However, please note that the company reserves the right to terminate your account or restrict your access to it without prior notice if you violate any of the terms of service, privacy policy, or other contractual agreements. This may also apply if your account has been inactive for an extended period if you are accused of engaging in fraudulent or illegal activities, if there is a request from the government or law enforcement, or if there are any other security-related issues.
